Staff leasing allows a user company to request workers from an authorised agency. The worker is employed by the agency but performs the activity in the interest and under the direction of the user company.

The structure includes two separate relationships: the commercial contract between user and agency, and the employment contract between agency and worker. It is useful when a company needs regulated and controlled flexibility.

User company

Organises and directs the work within its production environment.

Agency

Employs the worker, manages the relationship and retains disciplinary authority.

Worker

Works at the user company with the protections provided by the applicable rules.

Safety

Prevention and protection duties must be coordinated between agency and user company.

Elements to know

Authorised agency

Staff leasing can only be provided by authorised organisations registered in the relevant lists.

It governs the relationship between user and agency, including duration, duties and operating conditions.

It is the relationship between agency and worker and may be fixed-term or open-ended.
